These Terms of Use (the "Terms of Use") apply to the use of the website www.ihf.org.il (the "Website"), operated by the Israel Healthy Heart Foundation (R.A.), registered association no. 580024248, of 33 Jabotinsky Street, Ramat Gan (the "Foundation"). The Terms of Use govern the relationship between the Foundation and any person browsing or using the Website (the "User"). Use of the Website is subject to the Terms of Use, the Privacy Policy and the Medical Disclaimer published on the Website, all of which together constitute the entire agreement between the Foundation and the User in connection with the use of the Website. By using the Website, the User confirms that the User has read the Terms of Use, understood them and agrees to them. A User who does not agree to the Terms of Use is requested to refrain from using the Website.
In these Terms of Use, unless otherwise provided in any given context: 2.1 "the Website" – the website at www.ihf.org.il, in all of its language versions (Hebrew, English, Arabic and Russian), with all of its content and all of the systems operating within it; 2.2 "the Content" – all texts, images, illustrations, videos, audio files, graphics, logos, symbols, translations and files of any kind published on the Website, including their design and manner of presentation; 2.3 "online donation" – a donation made through the clearing system operating on the Website, by a donor in Israel, by means of a credit card or another means of payment that the Foundation may permit from time to time.
Use of the Website is personal and non-commercial. The User may review the Content for personal purposes of enrichment and awareness only. By using the Website, the User undertakes not to make any use of the Website that is inconsistent with the Terms of Use or that does not accord with the provisions of law.
By using the Website, the User undertakes to refrain from the following actions: 4.1 use of the Website for unlawful purposes, or for purposes that infringe the rights of any third party; 4.2 copying, reproducing, distributing, publishing, transferring to a third party, translating, creating derivative works from, or making any commercial use of any of the Content, except subject to the prior written approval of the Foundation or of the owner of the rights in the Content; 4.3 impairing the operation of the Website, its infrastructure or the server hosting it, including by deploying malware, performing intrusion actions against the Website, or creating an unreasonable load on the server; 4.4 using the Website by automated means (including bots, crawlers or scrapers), unless done for the purpose of adding the Website to legitimate search engines and in accordance with the Website's robots.txt file; 4.5 impersonating another person or entity, or providing false or misleading information when contacting the Foundation through the "Contact Us" page or when making an online donation; 4.6 collecting or extracting personal information of other Website users (to the extent identifiable), or commercial data concerning the Website; 4.7 transmitting to the Foundation, through the "Contact Us" page or any other channel of the Website, content that is contrary to law, including content constituting defamation, invasion of privacy, incitement, threat or infringement of copyright. It is emphasized that the Website does not currently permit the publication of content by users, and this prohibition applies primarily to inquiries and communications sent to the Foundation.
All rights in the Website and in the Content, including copyrights, trademarks, databases and other intellectual-property rights, belong to the Foundation or to those acting on its behalf, or to third parties who have granted the Foundation a license to use them. The mere presentation of the Content on the Website, or the mere use of the Website, shall not be deemed to constitute any transfer of these rights to the User. The User is hereby granted a limited, personal, non-exclusive and non-transferable license to use the Content solely for personal and non-commercial purposes, in accordance with the Terms of Use. This license does not grant the User any right to publish, reproduce, distribute or transfer any part of the Content to any third party. Where Content the rights in which belong to a third party appears on the Website, this will be indicated adjacent to it.
The Foundation enables online donations on the Website. The terms of donation are as follows: 6.1 donation through the Website is intended for adults only; by making an online donation, the donor declares that the donor is 18 years of age or older. The Foundation and the payment processor do not permit donations to be made by any person under the age of 18, in accordance with the requirements of the credit-card companies; 6.2 the donation is one-time or monthly, at the donor's choice at the time of making the donation. A monthly donation will be renewed automatically each month, unless the donor chooses to discontinue it in accordance with clause 6.4 below; 6.3 after the donation has been made and actually paid, a receipt for tax purposes under section 46 of the Income Tax Ordinance (subject to the validity of the approval) will be issued to the donor and sent to the donor by email or in another manner determined by the Foundation; 6.4 the donor may cancel a monthly donation at any time, by contacting the Foundation at info@ihf.org.il. The cancellation will take effect from the month following the request; 6.5 a request for a refund of a donation already made will be examined by the Foundation on an individual basis, taking into account the principles of applicable law and the fact that, under law, a donation to a registered association is, as a rule, of an irrevocable nature. To the extent the Foundation approves a refund, it will be made by the same means of payment by which the original donation was made, and net of fees, to the extent applicable; 6.6 payment details are collected and transferred by an external payment processor, and the Foundation itself does not directly hold donors' credit-card details. For further information regarding the handling of donors' personal information, the donor should review the Website's Privacy Policy; 6.7 with respect to donors in the United States – the donation process is carried out directly with the Central Fund of Israel ("CFI"), a tax-exempt 501(c)(3) organization in the United States, and in accordance with its terms and with applicable law. The Foundation is not a party to the donation transaction in such cases, and bears no responsibility for the actions of CFI or for the eligibility of the donation for the tax benefit in the United States.
The Website may contain links to external websites and information sources, including websites of professional associations, scientific articles, and websites of hospitals and research institutions. The Foundation is not responsible for the content, accuracy, availability or security of such external websites and sources, does not necessarily endorse their positions or conclusions, and does not conduct ongoing monitoring of their validity. The links are provided for the User's convenience only, and any use of or reliance on them is at the sole responsibility of the User.
Use of the Website is subject to the Medical Disclaimer published on it, which forms an integral part of the Terms of Use. Without derogating from the contents of the Medical Disclaimer, it is clarified that the information on the Website is informational and does not constitute medical advice, and that the mere use of the Website does not create a physician-patient relationship between the User and the Foundation or anyone on its behalf. Any medical decision requires consultation with a physician or other qualified medical professional who is familiar with the User's personal condition.
The Foundation makes reasonable efforts to ensure the proper functioning of the Website, the currency of the Content and the security of the information on the Website. However, the Foundation does not warrant that the Website will operate without faults, that it will be available at all times, or that it will be free of viruses, defects, intrusions or disruptions. Use of the Website and its Content will be made on an "As Is" basis, and the Foundation is not responsible for any direct or indirect damage caused to the User or to a third party as a result of the use of the Website, its unavailability, a fault in its operation, or reliance on the Content. Nothing in the foregoing constitutes a waiver of the Foundation's liability under any law that cannot be excluded under law, including liability for bodily injury caused intentionally or as a result of conduct that cannot be exempted under law.
The Foundation may, at any time and at its sole discretion, change the structure of the Website, the nature of the services provided on it, the scope or availability of the Content, add or remove content and services, change the user interface, and discontinue the operation of the Website temporarily or permanently, without prior notice. The User shall have no claim, suit or demand against the Foundation in respect of such changes or in respect of faults that occur in the course of their implementation.
The Foundation may update the Terms of Use from time to time. The updated version will be published on the Website and will apply from the date of its publication. A material change that worsens the User's position will apply only 14 days after its publication, unless an immediate change is required by law. The User is requested to review the Terms of Use from time to time, in order to keep updated as to their current version.
To the extent it becomes necessary, the User shall indemnify the Foundation, its employees, the members of its managing committee, the physicians and experts who author content on the Website, and anyone on their behalf, for any damage, loss, expense or liability (including reasonable legal expenses and attorneys' fees) caused to them as a result of the User's breach of the Terms of Use, or as a result of the User's improper use of the Website, provided that the Foundation has notified the User of the claim or the suit within a reasonable time after receiving it and has allowed the User to handle it in accordance with this clause.
The use of the Website and the interpretation of these Terms of Use are subject solely to the laws of the State of Israel. Exclusive jurisdiction in any matter arising from the Terms of Use or from the use of the Website is vested in the competent courts of the Tel Aviv-Jaffa District.
If any provision of the Terms of Use is declared by a competent court to be void, invalid or unenforceable, this shall not affect the remaining provisions of the Terms of Use, which shall continue to apply in full. The Foundation and the User agree, in such a case, to replace the void provision with another valid provision that most closely approximates the intention of the parties.
These Terms of Use constitute the entire agreement between the Foundation and the User regarding the use of the Website, and prevail over any prior agreement, representation or understanding on this matter. A waiver by the Foundation of a breach of any provision of the Terms of Use shall not be deemed a waiver of any other similar breach or of any breach in the future.
These Terms of Use were originally drafted in Hebrew, and this English version is provided for the convenience of English-speaking users. In the event of any inconsistency between the Hebrew and English versions, the Hebrew version shall prevail. The Website is not directed at residents of the European Union, and the use of the Website does not confer upon any User any rights under foreign law.
